Terms of Service
Effective Date: August 29, 2026
Last Updated: August 29, 2026
These Terms of Service (“Terms”) govern your use of the Outdoor Living Ventures website, communications, estimates, consultations, marketing services, and other interactions with Outdoor Living Ventures (“Outdoor Living Ventures,” “we,” “us,” or “our”).
By accessing our website, submitting a form, requesting an estimate or consultation, communicating with us, or otherwise using our services, you agree to these Terms.
Certain construction projects may also be governed by a separate written proposal, project agreement, contract, change order, warranty, or other document. If there is a conflict between these Terms and a signed project agreement, the signed project agreement will control with respect to that project.

Any estimate, quote, consultation, pricing range, preliminary design, or other information provided before execution of a written project agreement is provided for informational and planning purposes unless expressly stated otherwise.
Pricing may change based on factors including:
- Final measurements

- Labor requirements
- Engineering requirements
- Permit requirements
- Utility conditions
- Drainage conditions
- Access limitations
- Demolition requirements
- Material pricing
- Customer-requested modifications
- Unforeseen conditions
No project is considered accepted or scheduled until all required agreements have been executed and any required deposit has been received.
Unless otherwise stated in writing, estimates may expire after the period identified on the estimate or proposal.
3. Project Agreements
Construction work will generally be governed by a written project agreement describing the applicable:
- Scope of work
- Materials
- Pricing
- Payment schedule
- Estimated or guaranteed schedule, if applicable
- Customer responsibilities
- Warranty provisions
- Change-order procedures
- Exclusions
- Project-specific terms
Customers are responsible for reviewing project agreements before signing them.
The website, advertising, photographs, renderings, descriptions, and marketing materials do not modify the scope of a signed project agreement unless expressly incorporated into that agreement in writing.
4. Deposits and Payments
Projects may require a deposit before scheduling, material ordering, design work, mobilization, or construction.
The applicable deposit and payment schedule will be stated in the project agreement.
Payments may be required at milestones such as:
- Contract execution
- Material ordering
- Project commencement
- Completion of specified phases
- Substantial completion
- Final completion
Unless otherwise provided in the project agreement, invoices are due according to the payment terms shown on the invoice.
Failure to make required payments may result in:
- Suspension of work
- Rescheduling
- Withholding of materials or services where legally permitted
- Collection activity
- Other remedies available under the applicable agreement or law
The customer remains responsible for all undisputed amounts properly due under the project agreement.
5. Credit Card and Electronic Payments
Payments may be processed through third-party payment processors.
Outdoor Living Ventures may not directly store complete payment-card information.
By submitting payment information, you represent that you are authorized to use the payment method provided.
Any processing fees, returned-payment fees, financing charges, or other charges will be disclosed where applicable.
6. Project Scheduling
Project dates may be affected by numerous factors that are difficult or impossible to predict in construction.
Unless a specific date is expressly identified in writing as a Guaranteed Completion Date, all construction schedules, start dates, and completion dates are estimates only.
Estimated schedules are not guarantees.
Project sequencing and working days may be adjusted based on:
- Weather
- Ground conditions
- Material availability
- Inspections
- Permits
- Labor availability
- Equipment availability
- Customer decisions
- Change orders
- Site access
- Safety concerns
- Other active projects
- Conditions outside our reasonable control
7. $1,000 On-Time Completion Guarantee
Outdoor Living Ventures may offer qualifying projects a $1,000 On-Time Completion Guarantee.
The guarantee applies only when the customer's signed project agreement expressly identifies a specific date as the “Guaranteed Completion Date.”
If Outdoor Living Ventures fails to substantially complete the agreed scope of work by the Guaranteed Completion Date due solely to a delay within Outdoor Living Ventures' reasonable control, the qualifying customer may receive a credit of up to $1,000 against the final contract price.
The guarantee does not apply to delays resulting from circumstances outside our reasonable control.
Excluded delays include, but are not limited to:
- Rain
- Snow
- Ice
- Excessive heat
- Severe weather
- Wet or unsuitable soil conditions
- Storms
- Flooding
- Acts of God
- Natural disasters
- Material shortages
- Backorders
- Manufacturer delays
- Supplier delays
- Freight or transportation delays
- Product defects
- Material substitutions requiring customer approval
- Permit delays
- Inspection delays
- Governmental action
- Utility-company delays
- Utility-location delays
- HOA approvals
- Engineering or architectural delays
- Concealed or unknown site conditions
- Rock or unsuitable soils
- Underground utilities
- Previously undisclosed structures or obstructions
- Drainage conditions
- Environmental conditions
- Customer-requested changes
- Change orders
- Delayed selections or approvals by the customer
- Customer failure to make payments when due
- Customer failure to provide access
- Delays caused by other contractors
- Delays caused by third parties
- Labor disruptions
- Emergencies
- Safety concerns
- Theft or vandalism
- Equipment breakdowns that could not reasonably have been anticipated
- Any other event beyond Outdoor Living Ventures' reasonable control
Each excluded delay extends the Guaranteed Completion Date by the amount of time reasonably attributable to the delay, including reasonable time necessary to resume work, reorder materials, reschedule crews, complete inspections, or remobilize.
Substantial Completion
For purposes of the guarantee, “substantially complete” means the project has reached the point where the contracted improvement can reasonably be used for its intended purpose, even if minor punch-list, adjustment, cleanup, landscaping, warranty, or corrective items remain.
Minor incomplete items do not automatically constitute a missed Guaranteed Completion Date.
Additional Guarantee Conditions
Unless otherwise expressly stated in writing:
- The maximum credit is $1,000 per project.
- The credit cannot exceed the remaining unpaid contract balance.
- The credit has no cash value.
- The credit cannot create a negative contract balance.
- The credit is not transferable.
- The guarantee does not apply if the customer is in breach of the project agreement.
- The guarantee does not apply if payments are past due.
- The guarantee does not apply to delays attributable to customer changes or customer-selected products.
- The guarantee applies only if specifically included in the signed project agreement.
The On-Time Completion Guarantee is a contractual promotional benefit and is not a warranty against every possible construction delay.
8. Weather Delays
Outdoor construction is inherently dependent on weather and site conditions.
Outdoor Living Ventures determines, using reasonable professional judgment, whether conditions are suitable for construction activities.
Work may be postponed where weather or site conditions could affect:
- Worker safety
- Material performance
- Excavation
- Compaction
- Concrete
- Mortar
- Adhesives
- Grading
- Drainage
- Equipment access
- Finished quality
- Long-term durability
A day without active rainfall may still be unsuitable for construction because of saturated ground, standing water, freeze conditions, excessive moisture, curing requirements, or other site conditions.
Weather-related delays are not considered breach of contract unless expressly provided otherwise in a signed agreement.
9. Material Availability and Natural Variation
Construction materials may vary in:
- Color
- Texture
- Pattern
- Thickness
- Dimensions
- Veining
- Surface characteristics
These variations are common in materials such as:
- Natural stone
- Pavers
- Brick
- Wood
- Concrete
- Porcelain
- Manufactured stone
- Masonry products
Samples, photographs, showroom displays, renderings, and digital images are representations only and may not exactly match installed materials.
Material manufacturers may modify, discontinue, or temporarily run out of products.
If a specified material becomes unavailable, Outdoor Living Ventures may recommend a reasonably comparable substitute subject to the applicable project agreement and customer approval where required.
10. Unforeseen Site Conditions
Outdoor construction sometimes reveals conditions that could not reasonably have been identified before work began.
Examples include:
- Buried concrete
- Rock
- Poor soil
- Unstable soil
- Underground utilities
- Irrigation systems
- Drainage systems
- Unmarked private utility lines
- Tree roots
- Hidden structures
- Unrecorded improvements
- Contamination
- Improper prior construction
Additional labor, equipment, materials, engineering, or remediation required because of unforeseen conditions may result in additional charges and schedule extensions.
Outdoor Living Ventures will communicate material changes when reasonably practicable.
11. Underground Utilities and Private Lines
Customers are responsible for informing Outdoor Living Ventures of known private underground improvements and systems that may not be identified through public utility-marking services.
These may include:
- Irrigation
- Invisible fencing
- Landscape lighting
- Private electrical lines
- Private water lines
- Drainage piping
- Pool equipment lines
- Septic components
- Propane lines
- Other privately installed systems
Outdoor Living Ventures is not responsible for damage to undisclosed or improperly marked private systems except to the extent caused by our negligence or as otherwise required by law.
12. Property Access
The customer agrees to provide reasonable access to the project site during construction.
This may include access for:
- Employees
- Subcontractors
- Delivery vehicles
- Dump trucks
- Trailers
- Excavators
- Skid steers
- Concrete trucks
- Material deliveries
- Inspectors
Construction activities can temporarily affect lawns, landscaping, driveways, walkways, and other access areas.
Any specific restoration included in the project will be identified in the project agreement.
13. Customer Responsibilities
Customers may be responsible for:
- Providing accurate project information
- Providing access to the property
- Making timely selections
- Approving materials
- Responding to questions
- Obtaining HOA approval where assigned to the customer
- Removing personal property
- Keeping children and pets away from work areas
- Making payments when due
- Identifying private utilities
- Informing us of known property conditions
Customer-caused delays may result in schedule extensions and additional costs.
14. Changes to the Work
Changes requested after execution of a project agreement may require a written or electronic change order.
Changes can affect:
- Price
- Materials
- Scope
- Labor
- Schedule
- Completion date
Outdoor Living Ventures is not required to perform additional work outside the agreed scope without authorization.
Oral discussions about possible changes do not necessarily constitute an approved change order.
15. Permits, Inspections and HOA Requirements
Responsibility for permits, inspections, HOA approvals, engineering, surveys, or similar approvals will be identified in the applicable project agreement.
Governmental agencies, utility companies, engineers, architects, inspectors, and homeowners' associations are independent third parties.
Outdoor Living Ventures does not control their review or approval timelines.
Delays caused by these parties may extend the project schedule.
16. Design Renderings and Visualizations
Any rendering, sketch, photograph, conceptual drawing, mood board, AI-generated visualization, computer-generated design, or similar representation is intended to communicate general design intent.
Actual construction may differ because of:
- Field conditions
- Measurements
- Material availability
- Engineering
- Code requirements
- Customer selections
- Construction methods
- Natural material variation
The signed scope of work controls over conceptual marketing or design imagery unless otherwise stated.
17. Photographs and Project Media
Unless a customer objects in writing before or during the project, Outdoor Living Ventures may photograph or record completed work and construction progress for legitimate business purposes, including:
- Portfolio use
- Website content
- Social media
- Advertising
- Training
- Internal documentation
We will make reasonable efforts not to publish personally identifying information, people, addresses, license plates, or other sensitive details without permission.
If you do not want your project used in marketing, contact us at Info@outdoorlivingventures.com.
18. Warranties
Any workmanship warranty applicable to a construction project will be stated in the customer's written project agreement.
Manufacturer warranties for products and materials are subject to the manufacturer's own terms.
Unless expressly stated in writing, Outdoor Living Ventures does not provide guarantees regarding normal conditions such as:
- Natural fading
- Efflorescence
- Minor color variation
- Normal wear
- Weathering
- Natural stone variation
- Wood movement
- Minor concrete cracking
- Damage caused by misuse
- Damage caused by third parties
- Damage caused by improper maintenance
- Acts of God
Nothing in these Terms eliminates warranties or consumer protections that cannot legally be waived.
19. Maintenance
Outdoor improvements require routine maintenance.
Depending on the project, maintenance may include:
- Cleaning
- Sealing
- Joint-sand replacement
- Drain maintenance
- Snow and ice precautions
- Furniture protection
- Grill maintenance
- Fireplace maintenance
- Landscape maintenance
- Inspection of drainage systems
Failure to reasonably maintain installed improvements may affect warranty coverage where permitted by law.
20. Third-Party Contractors and Subcontractors
Outdoor Living Ventures may use employees, independent contractors, subcontractors, suppliers, designers, engineers, electricians, plumbers, or other professionals to complete portions of a project.
Their involvement does not necessarily create a direct contractual relationship between the customer and that third party.

We attempt to keep information on our website accurate and current.

Marketing calls will be made only as permitted under applicable law.
Consent to receive automated or prerecorded marketing calls, where separately obtained, is not a condition of purchasing services.

26. Automated Communications and GoHighLevel
Outdoor Living Ventures may use GoHighLevel/HighLevel or other communications software to facilitate:
- SMS
- Telephone calls
- Voicemail
- Appointment reminders
- Follow-up sequences

Some communications may be generated or scheduled automatically based on actions such as submitting a form or requesting information.
Use of automated tools does not change your ability to opt out of applicable marketing communications.
27. Advertising and Lead Sources
You may interact with Outdoor Living Ventures through advertisements or lead forms provided by services including:
- Other websites
- Search engines
- Social networks
Submission of a lead form constitutes a request for us to respond to your inquiry.
Marketing consent beyond responding to that inquiry will be handled according to the disclosures and choices presented when your information is collected.
28. Reviews and Testimonials
Outdoor Living Ventures may request customer reviews or testimonials.
Customers are free to provide honest opinions about their experience.
Nothing in these Terms is intended to prohibit or restrict a consumer from making truthful statements, submitting a complaint, or posting an honest review.
The FTC notes that federal law protects consumers' ability to share honest opinions regarding a company's products, services, or conduct.
We may publish testimonials that customers voluntarily provide, subject to applicable permissions and advertising laws.
29. Intellectual Property
Unless otherwise stated, content belonging to Outdoor Living Ventures, including:
- Logos

31. Third-Party Links
Our website may link to third-party websites.
We do not control and are not responsible for third-party websites, products, services, terms, or privacy practices.
Accessing a third-party service is at your own discretion.
32. Limitation of Liability for Website Use
To the maximum extent permitted by law, Outdoor Living Ventures will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of or inability to use our website.
This limitation does not apply where prohibited by law and does not supersede the terms of an applicable signed construction agreement.
33. No Waiver of Non-Waivable Rights
Nothing in these Terms waives any consumer right or remedy that cannot legally be waived.
If any limitation or exclusion conflicts with applicable law, it will apply only to the maximum extent permitted.
34. Indemnification
To the extent permitted by law, users who misuse our website or services agree to indemnify and hold Outdoor Living Ventures harmless from claims, liabilities, damages, and reasonable expenses resulting from that unlawful or unauthorized misuse.
This provision does not make a construction customer responsible for Outdoor Living Ventures' negligence or other conduct for which liability cannot lawfully be shifted.
35. Governing Law
These Terms are governed by applicable federal law and the laws of the State of North Carolina, without regard to conflict-of-law principles, except where another state's law must apply.
For contracts involving improvement of real property in North Carolina, North Carolina law prohibits contractual provisions requiring the contract to be governed by another state's law or requiring an out-of-state forum for disputes.
36. Disputes
The parties are encouraged to attempt in good faith to resolve disputes directly before initiating litigation.
Any project-specific mediation, arbitration, venue, attorneys' fee, or dispute-resolution provisions should be contained in the applicable signed project agreement.
These website Terms do not, by themselves, require a consumer to waive a jury trial or submit disputes to binding arbitration.
37. Electronic Signatures and Records
Where legally permitted, agreements, proposals, change orders, approvals, notices, and other records may be executed or provided electronically.
Electronic signatures and approvals may have the same legal effect as handwritten signatures where recognized by applicable law.
38. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
39. No Waiver
Failure by Outdoor Living Ventures to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision later.
40. Changes to These Terms
We may revise these Terms periodically.
The updated version will be posted with a revised “Last Updated” date.
Changes to website Terms will not retroactively modify the material terms of an already executed construction agreement unless the parties agree otherwise.
